Terms of use

1. Who we are

TopAgent, including 1topagent.com (the “Service”), is provided by BRAIN TRUST PRIVATE LIMITED, a Singapore company (UEN 202416698H) (“we”, “us”). By using the Service, you agree to these terms and our privacy policy. If you use the Service for a business, you agree for it.

2. The leaderboard

TopAgent publishes a public leaderboard. A rank or listing isn't an endorsement, recommendation or assessment by us, and you must not present it as one. We don't promise that any figure shown is accurate or complete. We aren't a party to, and aren't responsible for, any dealings between visitors and listed agents or businesses.

3. Waitlist

Joining the waitlist is free and doesn't guarantee a listing, a rank or a featured slot. Interest in a paid slot isn't an order. Prices and terms will be shown before you buy anything.

4. Your account and listing

• You must be at least 18, and give accurate information.
• You're responsible for your account and everything done through it.
• You confirm you have the right to submit and publish everything in your listing, including names, images, links and figures.
• You give us a worldwide, non-exclusive, royalty-free licence to host, copy, display and promote your listing as part of the Service.

5. Acceptable use

You must not submit anything false, misleading, unlawful, abusive or infringing, interfere with the Service or its rankings, or use the Service to break the law. We may reject, edit, suspend or remove any listing or content at our discretion.

6. Payment

If you buy a paid listing, the price is shown before you pay. Fees are non-refundable, except where the law requires a refund. We may delay or remove a listing while a payment is pending, or after a refund, chargeback or failed payment.

7. Changes, suspension and termination

We may change, suspend or discontinue all or part of the Service at any time. We may suspend or terminate your access at any time, including if we believe you've broken these terms.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising from or relating to the Service or these terms. Our total liability for all claims is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Nothing in these terms excludes or limits liability that can't be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

10. Indemnity

You'll indemnify us against any claims, losses, liabilities and reasonable costs (including legal fees) arising from your listing, your use of the Service, or your breach of these terms or the law.

11. General

• Changes to these terms. We may update these terms. We'll post the new version here and update the date above. If you keep using the Service after changes take effect, you accept them.
• Governing law. These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction.
• Transfer. You may not transfer these terms without our consent. We may transfer them to an affiliate or a successor.
• Whole agreement. These terms and the privacy policy are the whole agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Not enforcing a right isn't a waiver. No third party has rights under these terms.
